First off what is debt negotiation? Let us now discuss in further detail what must be done to achieve a debt settlement through negotiation.  In order for any creditor to be willing to negotiate and settle a debt, the account has to fall into a delinquent status.  Why?  Well the answer is rather simple if the creditors think you are in a position to keep paying their exorbitant monthly minimum payments that&rsquo;s precisely where they would enjoy keeping you.  The credit treadmill is what this rut is often called; just maintaining the minimums will keep someone in debt for more than three decades and cost them in interest more than five times the original balance.  So it is essential to fall behind on your payments for the creditors to be at all willing to speak in terms of negotiating your account.  As one may conclude this will have an adverse effect on their credit history there is simply no way circumvent this.  For such debtors who have already begun falling behind this is mute point; however for those who are current their score will be negatively affected.  So if you are talking with any debt negotiation companies and they are not giving this information to you then you would be smart to end the conversation right there.  Most scammer companies simply don&rsquo;t go into this detail.  Now it is understandable to be somewhat apprehensive about hurting your credit rating, but take into consideration that after the settlements start being reported this will have a very large positive effect on the credit score.  The reason is because over 30% of the FICO credit rating is made up of the &ldquo;debt to credit ratio&rdquo; which will be in a much better balance once the accounts have been negotiated and settled out.  Among the other negative effects of falling past due on your credit card cards is you will without doubt be on the receiving end of calls from collectors to collect on the debt, and there is only one way to stop  this and that is with the use of a law firm.  A New Jersey debt negotiation law firm can legally stop the collectors from calling and harassing their clients according to the Fair Debt Collections Practices Act (FDCPA), whereas a normal debt negotiation company does not enjoy this legal power.  So if you are talking with a company and they claim to have the power to stop the calls ask them how. They honestly don&rsquo;t have the legal standing to stop collection activity and those that claim they do may be nothing short of a scam operation so keeps your wits about you.  This brings us to the next possibility from falling behind and this is concerning the issue of being sued.  You must realize at any point after you fall behind on your debts the creditors possess the legal right to take you to court in an attempt to collect the debt.  Now before you get totally frightened you must understand that this is not the common practice of the creditors; it simply requires too much funding and time without a certainty of collecting money even if they were to obtain a judgment.  A debt negotiation law firm on the other hand has the legal right to continue negotiating a law suit outside of court after the debtor has been issued the suit.  This is a major benefit to the client, in the vast majority of cases the law firm will be able to agree on a settlement without their client ever needing to step foot into a courtroom.  On the flip side of the coin a standard company cannot legally contact a collector after they put forth the suit, therefore leaving the debtor trying to put the pieces together and figure out what to do, often leaving the client with a judgment.  This is probably the single biggest advantage a law firm has over a company!  This brings me to yet one more very critical aspect to consider when deciding on debt negotiation, particularly if you&rsquo;re considering whether to hire a law firm or a company.  The governmental regulators have been coming down extremely harsh on companies that aren&rsquo;t set up the right way, and are rapidly closing them down.  So what happens to the clients of these companies that get closed down?  In most cases they are stranded without a company to settle their accounts and are now set back for a huge sum of money; because in most situations the company will not have the money to pay back its clients for fees that have already paid out to the company.  This terrible situation occurs much too often, thus making the benefit of retaining a law firm with a sound working knowledge of the laws in your state ever more essential.  I know throughout this article I have basically been mulling over the negative aspects of New Jersey debt negotiation, but that&rsquo;s because I feel it&rsquo;s crucial for the debtor to know everything before using this as their plan for debt relief.  But you must understand the huge benefits of debt negotiation.  Many debtors find themselves out of debt in just over two years and wind up saving more than half of what they currently owe to their creditors.  This is such a large contrast from the minimum payment credit treadmill; which will be over thirty years to pay back with thousands more being spent on interest.
